You must follow a full and fair procedure in line with the Acas Code for any discipline or grievance case. The procedure you’ve followed will be taken into account if the case reaches an employment tribunal.
- The Acas Code of Practice is the minimum a workplace should follow when dealing with discipline and grievance procedures. The Code is not law but if a case reaches employment tribunal, the judge will look at whether the employer has followed the Code in a fair way.
The Acas Code mainly applies to anyone with employee employment status. To help working relationships run smoothly, employers might want to use the same procedure for workers.
